Start with the plan, not the cadastre
Start with the parcel numbers and the applicable plan. A rural plot’s cadastral description records its registered use, while the planning documents establish the framework for development. Road access, electricity and a neighboring building are useful facts, but each proposal still needs a planning assessment.
Montenegro adopted separate planning and construction laws in 2025, with further amendments in 2026. For land in Nikšić municipality, ask a licensed local architect to obtain the relevant plan extract and identify the designation, restrictions and urban-technical conditions for the exact parcels.
Restoring an existing building
Restoring an existing building begins with its lawful status. Routine adaptation, structural reconstruction, an extension and a change of use can follow different procedures. The current construction law provides for qualifying reconstruction within the existing dimensions of a lawfully built building, subject to the required conditions and permits. Ask the architect to classify the proposed work before commissioning a full design.
Legalization
An unpermitted or unregistered building needs a separate legalization review. A cadastral entry can carry an annotation recording construction without a permit. Check the original file, any legalization application, the applicable eligibility rules and restrictions on transfer. Permission to renovate should never be inferred simply from the presence of walls or foundations.
New buildings
A new building requires a parcel-specific answer about permitted use. Establish whether the plan allows the proposed house, agricultural building or tourism accommodations and what limits apply to location, size, height and access. A prefabricated cabin or a change from farming to visitor accommodations also needs this review. Choosing Land for an Eco-Retreat or Glamping Site covers the practical site questions.
Once the planning route is clear, the architect can set out the urban-technical conditions, design documents, infrastructure requirements and permits needed for that proposal. Water supply and wastewater disposal should be resolved while the layout is being designed.
The deliverable to ask for
For Gradačka Poljana, the useful deliverable is a written assessment tied to the actual cadastral numbers and a defined project. It should identify the relevant plan provisions and the next decisions required. A general opinion about what “rural land” permits is too broad to price a building project reliably.
