Property transfer tax: the worked example
At an agreed price of €600,000, a taxable land purchase in Montenegro produces €28,000 in property transfer tax if that price is accepted as the property’s market value. The purchase price and transfer tax therefore total €628,000 before professional fees and other expenses.
The calculation is progressive: 3% of the first €150,000 is €4,500; 5% of the next €350,000 is €17,500; and 6% of the remaining €100,000 is €6,000. These bands have applied since 2024.
Market value at acquisition is the tax base. The contract price is evidence of that value, but the competent municipal tax authority can replace an understated figure with its assessment. Ask the advisor handling the closing to confirm the taxable base, filing and payment arrangements. The statutory return and payment deadline is generally 15 days from the tax liability arising.
Fees at closing
Next, obtain written quotes for the notary, title registration, legal work and any sworn translation needed. Montenegro introduced a new notarial fee schedule in April 2026, so an old online fee table may give the wrong answer. Ask whether the quote includes VAT, copies, additional acts and registration expenses. Include survey costs if boundary marking is required, and establish whether an agency commission is payable under the arrangement you sign.
Annual costs
Annual property tax is a separate municipal bill. Its calculation depends on the property’s classification, assessed value and the taxpayer’s position. Ask for the latest Nikšić tax decision, which we can supply for the estate, and for a calculation for the proposed buyer, especially if a company will own the land.
A d.o.o. also needs a budget for accounting, filings and any payroll obligations. Ask for a yearly figure based on the actual plan for the estate. Foreign Buyers and Agricultural Land explains why the ownership structure matters.
Before choosing that structure, ask how a future sale would be taxed, including any gain realized by the company or its shareholder. Maintenance deserves a separate allowance for fencing, road work, the cistern and the house. For comparisons with other advertised holdings, see rural land prices per hectare.
